The Contract
A contract for the provision of the reserved track day and the rally event will only be concluded upon receipt of confirmation from DG Sport indicating that your booking has been accepted. Once your booking is accepted, a legally binding contract exists between us.
Price and Payment
The price for the track day and the rally event will be as advertised on the website or in the promotional documentation. DG Sport reserves the right to change the price at any time before your booking is accepted. In such circumstances, you will have the right to cancel your booking and receive a full refund. Unless otherwise agreed by us, full payment for the track day and the rally event must be made by bank transfer. In any event, payment must be received at least 40 days before the track day and the rally event.
Privacy Policy
DG Sport is committed to protecting the privacy of its customers and website visitors. DG Sport may collect certain personal data, the use of which is subject to Belgian law (Law of December 8, 1992, on the protection of privacy). This information will only be used to contact you and provide the requested information or to deliver the products and/or services purchased, where possible. Your personal information will not be shared with third parties unless required by law. In general, using the DG Sport website does not require providing personal information. However, you may choose to provide such information by filling out the "subscribe to newsletter" form or by booking your participation in one of our events. The information collected is only used to contact you for the fulfillment of the products and services purchased or, if possible, to send you requested information about our company and its activities. As is now common with most websites, our site uses cookies to record certain information about your use of the site, such as, among others, your preferred language. Cookies are small data files that may be placed on your computer's hard drive. The information obtained is used anonymously and in aggregate, and you cannot be identified. You are not required to accept a cookie we send you, and you can actually change your browser settings so that it does not accept cookies. The information collected is confidential and is never passed on to third parties unless we are legally compelled to do so. Right of Cancellation
All bookings are final, except as provided under "Cancellation by Us."
Cancellation by Us
We reserve the right to cancel the contract between us at any time if: (a) the number of bookings taken is insufficient to justify the continuation of the event; or (b) any other matter beyond our reasonable control arises. We will endeavor to give as much notice as possible in the event of cancellation and, if cancelled, any booking fees will be refunded to you in full or, alternatively, we will offer you, if possible, alternative dates or locations. In no case shall we be obliged to offer additional compensation for disappointment suffered.
Limitation of Liability
We shall have no liability to you for any failure to honor or for any delay in your booking caused by an event or circumstance beyond our reasonable control, including, without limitation, strikes, lockouts and other industrial disputes, system failure or floods, fires, explosions, or accidents. In particular, no refund (whether for travel expenses or the cost of the track day) will be made in the event of the track being unusable due to adverse weather conditions or other circumstances beyond our reasonable control. Similarly, we will not be liable if travel delays result in late arrival or no arrival at the track. No refund (whether for travel expenses or the cost of the track day) will be made if you or your vehicle are declared unfit to use the track, and you are referred to our operating procedures regarding the specific regulations that apply. High-speed vehicles can be dangerous, and under no circumstances will we be liable for any damage caused to a vehicle or other property. Therefore, if you are concerned about your vehicle or your civil liability toward third parties, you must ensure that it is insured for track use. Unless otherwise stated by law, we will not be liable to you for any indirect or consequential loss, damage, or expense (including loss of profits, business, or goodwill) arising in any way, and we shall have no obligation to pay any money by way of compensation. Nothing in these terms and conditions is intended to limit the rights you may have as a consumer under applicable local legislation or other statutory rights that may not be excluded, nor to exclude or limit in any way our liability to you for death or personal injury resulting from our negligence.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you), the applicability of any other part of these conditions will not be affected.
Entire Agreement
These terms and conditions, along with our current prices, practical guidelines, track day rules and conduct, booking form, and contact details, constitute our entire agreement relating to the provision of the services we offer you. Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature of the services offered by us. Except for fraud or fraudulent misrepresentation, we shall have no liability for any representation that turns out to be false or misleading.
Notices
All notices from you to us must be in writing and sent to our contact address at DG Sport, Avenue du Stade 27, 4910 Theux, and all notices from us to you will be sent by email or to the address provided on the booking form.
